| Q: SHOULD I HAVE A FAMILY TRUST?

| A: Family Trust, Intervivos Trust and a Living Trust are all the same legal tool; only the names are different. The primary purpose of such a trust is to allow the transfer of assets to your heirs without the involvement of the Probate Court. The fees charged by an attorney to prepare a family trust will range between $600 for a simple trust to $1,000 for an involved trust. The attorney's fees for the probate of an estate of $300,000 are fixed by law and would be $5,500. Additionally, the probate procedure can take a year or more to complete. Assets in a family trust can be transferred immediately provided the term and conditions of the trust permit. You should secure the advice of an attorney concerning the creation of any trust agreement.
